What follows is a list of some of the interesting New York DWI news of the week for June 4, 2010 to June 11, 2010:

  • The New York State Court of Appeals rendered a decision in People v. Ballman, 2010 N.Y. Slip Op. 04870, (June 10, 2010). The issue, and resolution was recorded as follows: “This appeal raises the issue whether Vehicle and Traffic Law § 1192 (8) allows an out-of-state conviction occurring prior to November 1, 2006 to be considered for purposes of elevating a charge of driving while intoxicated from a misdemeanor to a felony.   • Binghamton Assemblywoman Donna Lupardo urged the New York State Legislature to support her bill which would help fund Leandra’s Law by redirecting surcharge money from the General Fund to STOP-DWI Programs. According to www.wbng.com, the bill proposes that the STOP-DWI program would monitor the ignition interlock device requirement aspect of Leandra’s Law, which will take effect in August. Some New York counties are already expressing implementation-funding concerns.
  • An example of a case where the first prong of Leandra’s Law, which created enhanced penalties for DWI with a child in the car, was probably charged is this Long Island arrest involving a woman who was pulled over with a baby in the vehicle.
  • In Long Island, one allegedly drunk driver crashed into another allegedly drunk driver.
  • Several people were charged with DWI at a Dave Matthews Band concert at the Saratoga Performing Arts Center.
